Marshall, I believe that Mr. Liviakis is attempting to silence the critics of this company by filing what is known as a SLAPP suit (stategic lawsuit against public participation). I doubt that Mr. Liviakis is doing this with anyone's interests but his own in mind, and it's much harder to promote the stock price of a company that is close to death when pesky people keep pointing to the reality of the situation. BTW, this is not the first suit of this nature I have seen. As drakes pointed out to you, it puts RACE and Mr. Liviakis in the company of some very disreputable (not to metion bankrupt and delisted) companies. I am sorry that you find the free flow of opinions as 'out of hand'. Barb
