Isn't it very difficult to know or prove that an insider has gone the 'stock loans' route even after he files at the end of the term?

Tom, what is the point of this question? Other, than the sake of argument, it has nothing to do with CUST. Often, shares are restricted and not even able to be held in an account or useful for writing calls. This is all an exercise in the "what ifs" and hardly productive in the discussions regarding CUST..

Tom, yes stock loans frequently go undetected, a dirty business when used to conceal insider trading or to delay tax consequences of a sale.
