To cut ATHM out of the loop would be restraint of trade. The community doesn't have that kind of power. They can't pass laws that violate national laws. All laws they make must be consistent with national law though it may be at odds with laws of other communities. Such an action would be discriminatory. Open access means open to all viable contenders.
