The warning signs listed in the Crypto Gram seem to be valid ones and may be used when selecting an encryption software. However, the author of the Crypto Gram might want to list the following as an example also:

Yes, and he just gives it away too! Free crypto that has been in public domain since 1994 and undergone much cryptographic scrutiny. Sounds like a deal to me.

From what I can tell though, Triple DES will be the defacto industry standard until the AES algorithm is selected. Of course they're both free too.

And Certicom just released its quarterly numbers today. Revenues are increasing, but they're still losing a nice chunk of change. Maybe NIST's release of support ECC parameters will help, but it's hard to tell.
