That has nothing to do with AOL's and other established ISPs' copper markets. T is in the copper market both for telephony and Internet, so why shouldn't AOL et al do the same?

And that's why AOL's open access argument has no credibility whatsoever.

The cable cos took the plunge, although they still have a long way to go, in upgrading their infrastructure. The ILECs are still trying to figure out how to not cannibalize their 30%-45% leased T1, T3 markets. When the FCC includes dataservices (xDSL) as part of the UNEs the ILEC has to open up to co-providers then they have to deal with it.
