I have seen arguments that SI doesn't know about the controversy taking place.

I would think the change of the green background showed that they did..but even if that were coincidence - we now have the president of Go2net coming out of the woodwork on a Saturday evening addressing the situation.

So, now the controversy surrounds the meaning of "banner".

In a court of law, how much space would an ad have to take up in order to be considered a banner?

Would it have to have graphics?

What about enlarged font?

Would it have to be encapsuled in a colored background?

However, let's assume for the moment that the offending "whatever" is not a banner ad.

Is there anyone who doesn't think it is solicitation?

SI is big on the letter and the spirit on their terms of use.

Let's apply the same standard to SI.

I think this post of Brad's pretty well shows the spirit of what people could expect in terms of commercialism from this site before they paid their dues

An ad on every single message is in every way bombardment.
It is also solicitation for Datek.

So even if you buy into the argument that it is not a banner ad, it violates SI's promises that people relied upon when paying their dues.

When Josef complained to him about banner ads, and he made his reply, I think his intention was 2 things:

1) To clarify that the Datek ad is not a banner ad, and
2) To sincerely say that if any banner ads appear, to let him know.

Russ is CEO of Go2Net. He is NOT personally in charge of or overseeing SI on a daily basis. He could not possibly be involved then in every decision regarding changes to SI and would not necessarily know if banner ads were added.

Surely you must realize that Russ' role as CEO of Go2Net precludes him from personally managing SI, Metacrawler, Playsite, Stocksite, Haggle.com... etc. !! :)

Honestly, from all that I've heard about Russ: Witty? Yes. Sarcastic? No. He didn't get to his position by inflaming his supporters, or acting arrogant or haughty! In fact, I keep seeing references to his modesty and 'boyish charm'. (Which may annoy him, who knows? :)

I also don't think that when he or anyone else is going down the line when there are 2 million messages in the inbox that's he's thinking, "Hmmm... let me word this in such a way as to be sure that no one will misunderstand, misinterpret, mistake, miscommunicate... " :)
