"We've had one day of argument, and in that day counsel has mentioned the Holocaust, Rosa Parks and civil rights, whites-only water fountains in this courthouse, and Martin Luther King on three occasions," complained Ed Moss, an attorney for Brown & Williamson Tobacco Corp.

I am surprised at Rosenblatt's weak argument. Trying to turn this into a racial issue is pathetic, and is further evidence that the plaintiff's case is a house of cards. Trying to cater to the minority members of the jury by bringing up "Whites only water fountains" and "Rosa Parks" is sickening. This method of argument will most surely backfire.
