I said "generally immune." Milberg impermissibly set up Lexecon for future lawsuits by improperly naming it in the first lawsuit. That is abuse of process, not defamation.

And Pluvia was publishing allegations before the lawsuit was public

And once again, the fact that Sabratek had not yet issued a press release acknowledging the amendments to the lawsuit did not make them any less public.
