Question one - YES! Absolutely. There is, and always has been. Some
folks have found ways around those rules, and others just choose to ignore them.

An answer to question two depends upon two factors:

a) the "networking" ability (knowledge and relationships with short sources) and relative size of the brokerage-in-question's
Stock Loan and Borrow Dept.,

as well as

b) the size of the float of the issue in question.
