I agree with you we would all be better off if Pyng's public statements/promotional materials had from inception been phrased in general terms. But Pyng made the decision from the beginning to make specific timeframe statements.

And Pyng management has benefited from the several run ups that were specifically based on their statements. Mr. Jacobs sold shares into the run in 1998. I know that the number of shares sold were minimal and the sales were necessitated because he is not paid a salary. But he benefited regardless of the motive of the sales. So I do not think that Pyng management can absolve themselves from responsibility for their past misstatements by simply phasing future statements generally.
