I think the only reason they are on the Pinks is that they did not satisfy the requirement to provide financials to a willing market maker yet. If they do that, they are off the Pinks, IMO. The other deadline is separate, I would think.

Does anyone know if they are here in DC talking to the SEC, at a regional office in CA, none of the above?
