So true. The SEC didn't seem to have any trouble figuring out that there were major problems with that PR, did they? And yet the press release is still available through Bizwire.

I hope your attorney is using the UPCA situation as an exhibit in your reply brief. The fact that BW is not doing anything about that obvious fraud shows that their intent in this case is not to right a wrong perpetrated on innocent investors, but it is merely to "get back" at FBNers for embarassing it and exposing how little an investor can rely on a BW release. 425.16 seems like an appropriate remedy. I thought you guys found a case that said 425.16 applies to federal claims in federal court. Did they address that case in their brief? (I'm lazy and don't have time right now to read the entire brief). If not, your attorney should drag them through the mud over that omission.
