Tiger Lily: Thank you for your diligent response. I concur with Mark, it is refreshing to debate without personal abuse discoloring the picture.

I agree totally with the reply you posted. If only SSA would now take up the issue with MRPS and clarify the matter, then I would be content. For the sake of clarity, this is the essence of my question:

1. Was the original patent filed in Germany (or any other "first to file state"? If so, as your lawyer confirmed, the intellectual property is published, in which case, it invalidates MRPS' claim to be holding the intellectual property confidential.

2. If the secret to MRPS' technology is in the software (as we are now being told), and a patent has been applied for in the US, and twelve months have passed since filing, then any attempt to file in "first to file" states will be a waste of time. For this reason, many US companies now publish patents under protection of the PCT. This allows them to prosecute patents in other states around the globe. This point is important, because talk of MRPS doing business outside the US would be jeopardized (to some extent) by the lack of patent protection.
