I agree that there should be some choice among states for suitable regimes, and that true federalism would devolve more authority to the states...I also agree that there is an unfortunate obsession with "rights"...I do not see why you need to slander Hamilton or FDR. How is it more criminal, for example, to provide public works projects for those seeking work than to own slaves, as, say, Jefferson did. If one invokes the "historical situation", then why not do so for FDR too?
