FCC and Auction of spectrum to DEs: I'm the last to pretend to know what is in the statute that authorizes the auction of spectrum of designated entities. Perhaps there is a "market out" clause that allows the FCC, upon special application, to grant the right to acquire spectrum to entities that would not otherwise be eligible to acquire same if such spectrum would otherwise go unused, on the grounds of public policy and avoidance of waste of assets.

One thing is for certain, Q!'s tendrils reach far and wide, which is why it is one of the most interesting investments out there.

Do you think that NXTL is going to get any cooperation from QCOM in acquiring Nextwave? Wasn't the FCC just sued by QCOM to surrender significant spectrum allocations to QCOM? Will the spectrum allocations owned by Nextwave fulfill these requirements? Doesn't MOT own 25% of NXTL? Didn't MOT just countersue QCOM? Doesn't the Nextwave spectrum represent a significant bargaining chip for QCOM?

Sorry for the string of questions. I don't pretend to know how much of Nextwave is owned by QCOM but I think their $30 million write off last year is looking recoverable. Maybe QCOM could buy the licenses and sell them to LWIN at cost to expand their US interests. Again, I don't have a clue, but NXTL presumptions that Nextwave is ripe for the picking may be a bit premature.
