Tex, Xoma's main goal is to get the drug approved. How can you demand for retraction and sue Bloomberg without dragging in the FDA? ONE MORE TIME, the FDA prefers NO high profile in this process. This is NOT hiding behind the FDA, it is WHAT THE FDA WANTS. You may be a big shot in the publishing business BUT EVERYONE is a peon going before the FDA. YOU DO WHAT THE FDA WANTS, pure and simple. Especially if they are working closely with you on a subpart E BIOLOGICAL in a very complex trial which involves BOTH mortality and morbidity. BTW, I might be trying in the future to have this trial process brought before a sub-committee in Congress. There has to be a better way to get drugs for dying kids. Especially with the safety profile of this drug. I think Congress would be livid if they knew how this trial was required to have a mortality requirement.
