Nextwave's final outcome still unknown ,as the FCC heads to the US Court on September 14 to plead its case.With the FCC's creditability down in the toilet a ruling could come soon.The FCC may have opened the door to more then they bargained for.They may see the need to expedite the deep situation they created to a resolvable end. Nextel's pact with the FCC to gain Nextwaves frequencies contain the terms at 2.1 billion for 155 POPS which works out to a very low ball $12.73 per POP.Further in the terms there is a requirement that a 45-day shop period exist so that a carrier with a higher offer could beat out Nextel.There is a good possibility that the carrier Vodaphone-Airtouch,MCI Worldcom,or even a new alliance made up of "White Knight" entries(remember the cousin of Nextwave CEO sold alot of stock recently and "Other" types could all move in and bid.The outcome is indeed unknown but Nextwave may rise in a new form, out of asphyxiation, into the hyper speed of a CDMA internet protocol data network.
