Dennis, this could get interesting...
res- I could see something like 'Johnny has 2 mommies(or daddies) instead of a mommy and daddy. His family is different from most but that is ok.' (hence the tolerance)

Johnny speaks up...

But Miss Carmichael, my daddy and mommie say that homosexuality is not ok, and is dangerous because you can catch aids, just like it's not ok to marry my sister when I'm older.

Then the teacher could possible say....

"Well this is just the message we at the school want to put out but it's important to listen to your parents. Hurting anyone is wrong and many people have needlessly hurt gay people because of their lifestyle."

But what do you figure the chances are of that happening? More likely she would say something like... "Well Johnny, many older people like your parents believe that way, and that is the reason so many horrible violent acts have been committed against homosexual people".

Now look what you have just done. You have pitted the mores of the school, against the mores of the parents. You're the teacher, please describe for me a realistic verbal scenario which would prevent this from happening? And why is it so important for homosexuals to impart their moral values on my children?

As for the other issue with regard to premeditation....

If a bunch of jocks beats up a geek. Shouldn't that be a "hate crime". If a group of black kids beats up a white kid because he is white. Isn't that a hate crime? (which by the way happened to me on numerous occasions growing up in D.C.) If a bunch of devil worshipers shoots up a high school and purposely kills a christian child because she professes belief in Jesus, isn't that a hate crime?

If premeditation were the only criteria as you suggest. Many other beatings would be called "hate crimes". The simple fact is they are not, so the term is nothing more that "political correctness" applied to violent acts. In other words, its simply a catchy phrase which politicians use to get their liberal constituents to vote for them.
