It would seem to me if they own the deep rights to the 40 acres in the centre of the property which bkp jvs are going to draw the gas from then then sop would be a percentage owner of anything coming up in the area

S&P, Here in Ohio when one drills a well that drains anothers property the entity doing the draining has to pay the drainee! Perhaps SOP can just collect from the JV. Well, <GGGG> , I am sure there is a reasonable solution to this as wells have been adjacent for years.
