The question was decided when the Bill of Rights was adopted. The Board was attacking the Constitution, as zealots frequently do.It would take far more than an uneducated school board or even a majority of Jayhawkers (no insult, Kansans profess pride in the name).

I was under the impression that this might survive the separation of church and state rule, because religion was offered as an option somehow... this is somewhat similar to the "prayer in school" argument. Its not like that ten commandments thing where there is no chance of it making it through the courts... do you agree? thx

Perhaps because it is by no means well-settled. I have known many intelligent, good-hearted (to wit, reasonable) people to whom the concept of evolution as the scientists explain it is unacceptable. It is unacceptable on religious doctrinal grounds. This is one of those issues where the primarily religious and the primarily curious (seeking knowledge, not dressing funny) square off and dig in.
Let's face it. You got two groups of people. One says "We are looking into how the universe works" and another that says "We know how the universe works, how you fit into it, how it got that way and what you need to do to get the best deal out of life." You have to be, like, a Saab owner or something to pay attention to Pitch #1.
