There are a couple of things that SanDisk has done extremely well.

1) Make the ground-breaking discoveries leading to the development of flash memory.
2) Present the CF standard to the Grandfather of standard film photography and get them to design it into their first digital camera.
3) Get innumerable other companies to follow that lead.
4) Create an outstanding reputation by delivering quality and reliability in their consumer products.
5) Solicit an astounding number of retail outlets to carry their product which now canvas the world.

and...

6) Defend their patent portfolio.

Craig,

I read you post earlier today and it started to let my imagination get the best of me. I tried to relax and rationalize. I went out to do some landscaping in my yard (and try and forget about what you said) when your remarks rudely interrupted my placid state. I began to ruminate about the Lexar suit again. Then, in the process of formulating a response, I was surprised by a wild creature in my garden...

...a fat old toad.

This was an extremely unusual occurence, because most of my neighbors have applied enough weed killer and fertilizer as to eliminate the possibility of any amphibious procreation. Also, we live about two blocks from an interstate and have never seen anything of this nature ever before. I could only think of two things to do. First, alert my kids of the discovery. And second, shoot the darn thing...

...with my digital camera.

If anybody wants digital proof, just send me an p-mail with your e-mail address.

Now I have a permanent mental association with Craig and a warty old toad.

You are kidding about trying to apply logic to the actions of "investors", aren't you? Someone will buy anything. Heck, people have even given APM more money more than once.

This investment means nothing.

two possibilities;
1) Only if one assumes that these people know what they are doing. Plenty of people put money into Iridium and ICO long after I at least could see they were only going one way.

2)Its always possible that Lexar could lose the suit, pay damages, and still have a viable business. (I dont know that, I havent looked at their financials, I'm just saying its possible)

If Lexar were viable even if they paid royalties (and other vendors are, so why not Lexar), then Lexar have been pretty astute at getting their product out into the stores and OEMs and would quite possibly be a good investment.
