Daniel,

To stay on the NASDAQ SC (small cap) I think you only need
$1 Million of tangible assets. I think NINE qualifies. Hunting on the NASDAQ site should give the right answer.

There is one more thing...NASDAQ can delist companies with
little or no notice if they feel the companies are engaging
in shenanigans with their books...I guess it takes a crook to know a crook!

My 2 favs in the restaurant biz for pennies. . . are PDIM and BYBI. . .the former scored a hat trick of awards for their Mexican chains, which include a 15 year favorite of mine. . .El Torrito. . . .[I used to live across the street from El Torrito, Fridays and Bloomingdales down in Miami. . .before Andrew wiped much of it off the map.]

BYBI has some great looking financials and valuation, while it continues to expand its business. Based in Memphis, this chain never ceases to surprise me in the "how many are in line when I drive by?" category. Lines at the counter and at the drive-thru. . .yet I never see a single advertisement.
