I'm pretty sure it was nihil that was talking about the 9th district court of appeals. Now, I can't find the particular post... however, here is something that might interest you.

Gunmakers Can Be Sued By Victims State Court of Appeal rules in 101 California St. massacre case
For the first time in history, a state appeals court ruled yesterday that gunmakers can be held legally responsible for the criminal use of their weapons.

Kline wrote that Ferri's compact but powerful semiautomatic firearm was the ``weapon of choice' for criminals because of several distinct features, including a threaded barrel for silencers and flash suppressor. The TEC-DC9 was also used by the two teenage gunmen in April's massacre at Columbine High School in Littleton, Colo.

In an advertising brochure, Kline noted, the makers boasted that the gun had ``excellent resistance to fingerprints' because of a special finish. Justice James Lambden joined in Kline's 77-page decision.

A wonderful example is McKinley praying all night about the Philippines. He decided to to keep them.

Actually it was Elihu Root, attorney for the sugar trust, who told him to keep them. God and prayer had nothing to do with it. Made a good story, though. Just like that story about not knowing where the islands were until we had them, despite cables (still in Naval archives) specifically ordering Dewey's fleet to proceed to Hong Kong and prepare for offensive operations against the Spanish Pacific fleet.
