That's true, but we pick our times (when it doesn't matter or we are sure to win). Courts really count when they have mandatory jurisdiction. Our opting out is really unfair to most weaker countries who are left with nothing except war (which they would lose) or terrorism. If we want world peace we've got to go all the way and be prepared to lose when we are wrong and even look wrong. I would like for S. Korean victims to sue the US in a new Court of Human Justice (private individuals cannot sue in the International Court). They can sue the US in its own courts now (and are doing so), but no one can judge their own cause. Perhaps we could let them have a special court made up of lawyers of Korean ancestry. I could easily identify an excellent court for this purpose from lawyers in Hawaii that I know.
We have judges of Hawaiian ancestry deciding suits by Hawaiians about the theft of lands and wrongful overthrow of the illegal Hawaiian kingdom.
