He was probably also counting on human inertia, a lot of people would just give it up rather than try for a refund. I was reading recently about a computer mfg. co. that gives a rebate if you sign up with their internet service provider, part of their actual business plan is the assumption that most people won't send in their rebates. I never do, myself, and when I do I never get a check back.
