ps. on defining murder one dictionary uses the following (in part)

... and you are not even out of the first paragraph!!!

so God kills, but does not murder. Because for one He's not appart from us, if he decides us guilty we are, etc... What a really nice moral explanation of God's actions.

What if the only reason for God killing someone was because He could and felt like it. What about using someone to set an example who is otherwise blameless? Morals get foggier and foggier as you go.

The Law said that we must not murder and he that murders MUST be put to death ! How can you try and say that the penalty is as big a sin as the crime !!

You still never answered my question.

M--It is true that God is not held by His commandments to us but, in this case he is asking Moses,a man,to vary from the commandments. If it was God who wanted to kill all those people, so be it but, he asked Moses to do it. Therefore, I believe that the use of the word "murder" in the commandment is more appropriate when you consider what followed after the commandments were issued.
