happens often. This is supposed to be a competitive, capitalist econmomy, after all.

Pricelines's patent is untested. It is really a concept. Many industry experts are not putting much credence in the patent's defensibility. If msft were worried about it they would have settled in pre-filing discussions, which I am sure occured.

The onus will be on pcln to prove their point, since they are the plaintiff. Much harder to prove a positive than defend against it. MSFT already has the advantage.

The market sure is not exactly thrilled with the prospect of this thing getting tested!
