i for one do not believe msft will sell off at all when jackson makes his announcement. i think msft goes up on a finding agains msft and i think msft explodes on a finding in favor of msft.

any mutual fund manager (with the exclusion of hedge funds) "betting" on this decision is breaching his/her fiduciary responsibility to mutual fund shareholders. i certainly don't think anyone sitting on msft is waiting for a ruling against msft and then planning to sell after.

it's almost a given that jackson will rule against msft. if you were to tell ibm shareholders that ibm was going to drop the bomb before it actually happened, do you think they would have waited for the bomb to come down then sell?

this is a case of sell the rumor and buy the fact. msft has been depressed for months because of this impending announcement. if anything, positive or negative, this will clear the air for msft and allow it to resume it's forward march.

the uncertainty in this case is whether jackson could rule favorably for msft and therefore the market reaction can only be a positive one. any negative reaction would be ever so brief and i'd be surprised find msft finishing the day down which ever monday this happens on unless the overall market is down for the day.

there are obvioulsy daytraders playing this "event" but for long term shareholders jackson's findings is a non event.

remember folks, it's never too late to buy msft!!
