Combo of the judge keeping them in limbo land until his royal fatness makes some kind of decision, and the big brokerage houses playing games in preparation for entry into the DOW.

I attribute the articles to hatchet journalists taking potshots while MSFT is on hold, we all know the very best time to kick a guy is when he's down.

There is the distinct possibility that MSFT and the Justice Department are attempting to reach an accord, thereby pre-empting a decision by the court. If an accord can be structured, both sides might be able to claim a victory.
