If they wait a couple of months, will there be a basis for the suit against Cymer?

Right now, 7 more points on the stock and two years worth of interest would be the lost for the crybabies.

If we hit 55-60, tell them to stick it.

These suits take years to make it through the courts. Cymer has their heart set on fighting it. At some point, you have to wonder if it isn't better to just pay the extortion.

On an economic basis it might make sense to just pay up so that it will go away. If more companies fought these suits, however, maybe that would keep them from being filed in the first place. It still might make sense for Cymer to fight the suit if it gives them a rep of not caving in. The sharks might leave them alone in the future, preferring an easier target. Personally, I'm one of those "Millions for defense, but not one cent for tribute" types. That posture is much easier when it's not entirely my own money at stake, of course :-).
