ECI is claiming TI's DSL patents are based on technology gained from work they did together nearly a decade ago. I may have claimed more for ECI than they deserve when I referred to patents. They're actually challenging the validity of TI's patents. This means they're also challenging Stanford University who is co-holder of several.

The point of this exchange is not patent infringement but the fact a company with a strong position will not be brow-beat into settling if they know they're right.

You're right that ECI is not at the forefront of DSL development. However, they're ready to ship products based on TI's DMT and they can't until the case is settled.
