In a way I agree with you, but it's like exploiting a tax loophole. Those things can violate the spirit of the rules/laws in which they appear, and thus tend to get changed if their use gets out of hand. At that point, those who relied heavily on them can be left in an awkward situation.

JMHO, as always, and not even close to a legal opinion.
