JM, I don't see how VLNC would be liable in a class action for statements made in the Korean press which presumably are attributed to Hanil. If you look at VLNC's SEC filings, they clearly say Hanil is not expected to ship significant amounts of product during FY 2000.

To me, VLNC's vulnerability to a class action would relate to their own confusing statements. Their SEC filings still state that the company is in the development stage, while their press releases refer to themselves as a "leader in commercial production." Personally, I tend to believe the SEC filings rather than the PR hype because of the safe harbor allowed for press releases.
