The NASD is not a court, and while some offenses may be viewed by most folks as "criminal", it's strictly between the NASD and its member. Criminal charges and civil suits may be filled separately in a court of competent jurisdiction, before, during or after a NASD determination, assuming the statute of limitations hasn't run. It's two separate forums. So the answer to your question is "No" - a NASD determination is not a felony.
