To all - almost no mention of QCOM in new Barrrons (just a sentence in a piece about put/call ratios giving QCOM as one of several examples).

Peter, My purpose is to defend Qualcomm, not $ill. Though defending $ill at the same time is not a bad idea. My father went and defended 'Europe' against Hitler, all the way from New Zealand because you have to stop this sort of stuff at the beginning. Hoping for peace in our time by allowing a few sacrifices does not satiate these people. Saddam would expand to cover the universe if he was allowed to move a muscle. So would millions of people. I know the analogy seems weird to most people, but that's the way I see it.

Now Peter, you really haven't read the stuff around this case have you? Did you read Thomas Sowell's excellent comments? It's a question of defining the markets tightly. Well, not even tightly in this case. Yes, you are right, CDMA has a small share of the wireless interface market right now, but EVERYONE predicts that 3G and ALL mobile terrestrial voice interface will be CDMA by Q! Also, the space segment for mobile voice will probably be nearly all CDMA by Q!

So in 10 years, what isn't Q! won't be worth thinking about.

True enough, in total telephony including data, CDMA by Q! will still be only a tiny portion. Most will flash around fibre to fixed locations. By far the vast majority will do that. So if Qualcomm could get the boundaries of the anti-trust case [not that Qualcomm has any trusts] drawn to include total telephony, there would be no worry.

Hey, how about going to total information movement, including body language as the boundaries of the anti-trust case? Then Q! would disappear into less than 0.1% which would definitely not be a monopoly. Mostly people will still access data by looking around themselves in 3D.

But suppose they draw the boundary nice and snug to include only CDMA technology. Or maybe even 3G technology. Or say, voice mobile technology. Ooops a daisy. Qualcomm is instantly a lethal monopoly damaging consumers by consumers choosing to give them money.

So, your idea that Qualcomm won't have a monopoly is simply false.

HDR and cdma2000 will almost certainly become the 'monopoly' data standard in the USA. GPRS and EDGE are not going anywhere. ATT is just making hissing noises. EDGE is in the crap, to coin a phrase. See a post several back for example. Of course Qualcomm is going to make ASICs which work better with their standard cdma2000 and HDR than with W-CDMA or other weirdness. They SAY they will try to make an ASIC to work well with all 3G, but I bet the W-CDMA warble puts people off anything but cdma2000 and HDR.

So the same accusation you made against Microsoft will apply to Q! Of course companies try to make their own stuff work best.

Microsoft, like Qualcomm, has partnered with anyone who will promote their stuff. Microsoft uses distributor channels, the same as Q! does. Each just owns the software and licenses it. Microsoft has partnered with Intel for ASICs and they jointly make great stuff. They have partnered with Dell, Compaq, IBM and anyone else who will sell their stuff [not changing it or fiddling with what goes where, but using it as designed and built and licensed].

Qualcomm has done the same. Qualcomm doesn't use their dominant position to control or consumer their partners? Oh? Have you heard of Korea Telecom Freetel. Not only is Qualcomm controlling it and consuming it, they have ganged up with Microsoft to do so! They have bought stock on condition that HDR be rolled out. Q! and MSFT are leveraging their monopolies to enter another field, HDR and wireless data.

I really think the case is pretty clear. We better send Janet Reno, Joel Klein and Judge Jackson to throw Irwin and Co in jail with $ill for doing dastardly deeds across the planet.

Incidentally, I see that since Al Gore's visit to $ill Gates' Evil Empire, a 'mediator' is to be appointed to settle the concerns between the Department of Justice and Microsoft. news.cnet.com
Microsoft used to donate no money to political parties. Presumably even when playing golf with Bill Clinton, he didn't realize it wasn't just a fun day out for important people. America has got the best politicians money can buy! You should see what we can afford and the election here is on Saturday - woe is us.

So I guess $ill will make the appropriate financial contributions, settlements and SHOW ME THE MONEY appeasements and go happily on his way.

Qualcomm has presumably had the good sense to pay the necessary protection fees in advance. They have Brent Scowcroft on the board. They have been in the Gore good books for years. Bill Clinton has paid social calls. Irwin Jacobs has been awarded the Technology Medal, among other awards, so he is held in high esteem. This will all help. A LOT!! But what if the Republicans win?
