AB: Given Posner's point of view why would you come to your Jacksonian conclusions that MSFT should use a fixed price schedule- ORCL doesn't. Why should MSFT license its primary intellectual property - this is confiscatory and there is no barrier to being smarter and coming up with a better O/S. Your point on his putting the arm on DOJ although not popular in the media would indeed help DOJ come out of the clouds having been elevated to hypoxic levels by the hot air of Jackson's bogus and biased decision.JFD

THE DOJ has not recieved a ruling, positive or negative, at all. All we have thus far is a finding of fact. The legal decision is still pending.
