Clearly the amazingly narrow definition of MSFT's market is a huge problem with PJs FoF, because by his logic AAPL, SUNW, and ORCL are all monopolies in their markets as well.

The penalties I suggested are not what I consider fair, but what I feel Posner might be able to negotiate. Are you saying you believe he can convince the DOJ to accept less? I don't. Posner has no real power to actually decide anything here, so there's no way he can strong-arm the DOJ even if that is his inclination (and at this point it's an awfully big "if" anyway).
