Here's a link to the article in WSJ. Says that Supreme Court let stand an appeals court ruling WRT the definition of statute of limitations. Thus, the shareholder lawsuit is allowed to proceed.

Mark, IMO it was never in doubt that this lawsuit would return. The important thing is that Valence has vindicated itself by finally being able to deliver the goods.

The fact that they can make AND DELIVER li-poly cells now should take any misrepresentational issues pertaining to the product itself out of the lawsuit, turning it simply to a question of timing. In other words, time has shown that this was not a fly-by-night, pump-and-dump company; rather, it sounds to me that it was one whose R&D department may simply, though unfortunately, have lagged behind its sales force.

I personally do not see this lawsuit affecting the long-term VLNC stock price, as they are in fact the first to market with a much-needed, eagerly anticipated product. Their biggest problem at this time is still how to handle all the demand. All IMHO, of course.
