Tommy, here's my favorite part of the Weiss & Yourman complaint:The defendants engaged in a scheme, common enterprise or common course of conduct to artificially inflate and/or maintain the price of Hitsgalore stock by, inter alia, issuing materially false and misleading statements, reports and press releases to the public regarding the Company's business, management, operations and future prospects. These statements and documents portrayed a false picture of the Company and misrepresented and/or failed to disclose material adverse facts concerning Hitsgalore. So, let's see what period of time they are talking about:...during the period of February 17, 1999 through and including August 24, 1999 (the "Class Period")... And not let's check which wire service they used: -----Hitsgalore.com, Inc. Attracts $10 Million Investment RANCHO CUCAMONGA, Calif.--(BUSINESS WIRE)--April 16, 1999-- Hitsgalore.com, Inc., (OTC BB:HITT) announced that it has entered into a Letter of Intent with the Life Foundation Trust for a $10 million investment in the company. hitsgalore.com ----- Hitsgalore.com Announces Agreement in Principle for $100 Million Equity Investment RANCHO CUCAMONGA, Calif.--(BUSINESS WIRE)--May 10, 1999-- Hitsgalore.com, Inc. (OTC BB:HITT) today announced that it has an agreement in principle with the Life Foundation Trust for an equity investment of $100 million at $25 per share.hitsgalore.com ----- Hitsgalore.com, Inc. Announces a Profitable 2nd Quarter RANCHO CUCAMONGA, Calif.--(BUSINESS WIRE)--July 23, 1999-- Hitsgalore.com, Inc., (OTC BB:HITT) has announced preliminary revenues and expenses for the 2nd Quarter, the three months ended June 30, 1999.hitsgalore.com ===== Now let's see what Business Wire has to say about "untrue" information:Business Wire's [CEO] Mr. Lokey says... the wire service carefully screens press releases before they're distributed. "We don't just sit still. I can tell you that anyone in the future that moves a false story on our wire is going to get sued and we're going to win it," says Mr. Lokey. "We probably do as well or better a job of weeding out this stuff than The Wall Street Journal does," he says. Message 12211338 So, does that mean Business Wire has obligated themselves to either sue HITT or launch their own independent investigation? Even more confusing, isn't Business Wire implying that you can trust them like you do the Wall Street Journal? If that trust in the Business Wire name is why people believed the "false and misleading" press releases and thus bought HITT stock, might BW be somewhat responsible here by their own admission? Hmmmm..... Wonder if Weiss & Yourman read the thread? ;^) - Jeff
