To date, unchartered water, and since IRS generally is prohibited from issuing regs that are retroactive unless IRS issues the regs within 18 months of the date of enactment of the provision, you're probably OK to write in-the-money options without running afoul of the constructive sale provisions.

Lab, this is great, and I gladly stand corrected and defer to your better knowledge in this matter. Apologies for passing out theoretically accurate but (practically-speaking) completely false information.

<sigh> Now I have to go back and see where in the portfolio this 'new' strategy might fit in...have at it, JWCB.
