What law school did you go to? You know very well that the Constitution says nothing explicitly about segregation. Did you skip class on the day they discussed Plessey v. Ferguson, in which the Supreme Court said that separate but equal is not prohibited by the Constitution? Did the Constitution change between that time and Brown v. Bd. of Education? Of course not. What right did the Brown Court have to tell Kansas how to run its schools? Isn't that big government--via a "legislating" Supreme Court-- interceding in a very local matter?

All local laws aren't good, are they? Sometimes the federal judiciary has to overturn an unjust local law through a new, updated reading of the same Constitution that was before previous Justices.

By the way, "big government" did protect against the Alabama jury. The federal judiciary overtuned the verdict.
