I'm not a lawyer either but it's the 5th Amendment that has "Takings" clause.FWIW.

Steve: Great Post. The irony of this thing is that the judge after painting himself into a corner in prejudging this case due to his intemperate loathing of MSFT has made this a personal thing and is now hoping that Posner will save him from himself before the Appeals Court embarrasses him again. JFD
