Art- I don't think we are talking about injunctive relief hear. All of the motions appear to be for "partial summary judgement" on substantive issues. SJ is tough to obtain - It means that there are no "material issues of fact" as to a claim and merely issues of law in favor of the moving party. It is conceivable that all motions could be denied as facts remain in issue as to the claims. IMHO

Art, The upcoming hearing is important.

Lexar asked for a continuance so they could prepare for the March 10th date. Eli said during the conference call that the hearing on the motion for partial summary judgement was extended for 60 days at the request of Lexar. His point was that they already had two years to prepare, why do they need another 60 days?

Well, maybe it is just to get the IPO off the ground?

Who in their right mind would attempt an IPO with this type of potentially crippling law suit in the courts??? If you read Lexar's registration statement with the SEC I think SanDisk is actually mentioned more times than Lexar Media.

In preparation for this hearing it appears that SanDisk is pushing hard for a conclusion. They are pulling out all the stops. According to the information Mike uncovered even Dr. Harari has submitted a statement on behalf of SanDisk. That really bothers me because it distracts him from either contributing to a new patent or focusing on forwarding SanDisk's position in the market place.

Lexar needs to get this issue behind them and either pay up or get out of the CF business. This protracted litigation is helping nobody.
