Individuals and corporations are required to pay sales or use taxes if they are in a state with sales or use taxes.
Most individuals do not pay this tax-they commit a crime-when they buy from Dell. The states do not in a global way go after the individuals-it is too hard to do so. Some states do go after corporations and other businesses and most businesses do pay the proper taxes. I think Dell has a different set up re businesses when one goes to its webpage or calls in- it asks whether the purchase is for business and treats it differently. Bulk purchases take a risk of being caught on an audit. Actually, so do individual purchases.
Dell benefits a great deal from the failure of its customers to pay taxes . GTWhas given up this advantage by opening country stores- so it has a presence in states and I think must collect sales tax.
I have posted about this a number of times. So, have others. It is important and I am surprised that Kemble, who is so active on this board and spends so much time re Dell doesn't know about it.
The Congress for ridiculous reasons has not taxed internet sales by having the vendor collect the tax.
