In the high school I attended there was a kid who has clearly gay, and he got bashed around with depressing regularity. Everyone knew it, nobody cared. I doubt it's much different today - as long as the victim doesn't die, or doesn't end up seriously injured, the assailants get away with it. You can not legislate away the irrational fears and hatred of some members of our society. No. But you can punish the actions inspired by those fears and hatred, and you can request prominent individuals, such as leaders of religious groups, to stop making statements clearly intended to whip those fears and hatred up to the point of action.
