Amazing how rumors can fly - glad to see the Alcatel one put to bed. Only goes to show that you do you own DD and trust your gut.

Question though... To what extent does the Justice Department consider non-US concerns? Surely if something favors US-based firms and helps them be more competitive globally then that is a good thing for the US. I fail to understand therefore, why Justice, within limits, cares about foreign concerns. Can someone please explain?

Re: Alcatel has not filed an opposition to the proposed merger. Any discussions involving Alcatel with the Justice Department have been to provide factual industry information requested by the Justice Department. Krish Prabhu, Chief Operating Officer of Alcatel Telecom stated, "We value the relationships we have developed with both JDS Uniphase and E-Tek and have been in discussions with them to ensure that Alcatel's long term interests will be protected. We look forward to continuing good relationships after the merger is completed.

Now, that's an interesting development - Alcatel releasing a statement that it "looks forward to continuing good relationships after the merger is completed." It is becoming increasingly clear to me that Alcatel is posturing and looking for continued favorable pricing.

I continue to believe Alcatel's concerns can be managed and, based upon Alcatel's statement, the initial reaction to Alcatel's "complaint" was either inaccurately portrayed or has been quietly addressed by JDSU/ETEK.

Parenthetically, I wonder if the initial quoted remarks of Paul Harrison, Alcatel's USA Vice President of Product Strategy, were inappropriate. The new statement was issued by Krish Prabhu, COO of Alcatel. Did Harrison speak out of turn?

I would expect a statement from JDSU/ETEK to be released to further clarify this matter.

Re: Alcatel Press Statement

Sounds like Alcatel has probably struck an nice long-term contract to control prices.

I'm delighted...whatever happened.

This ANOTHER example of how emotions can control trades. Although the spread increase coupled with the rumors spread by the media were certainly unsettling the as couple days, it appears many let fear get the upper hand and were washed out of their position in ETEK. The same thing has been happening with GSTRF...and happened with QCOM in the old days.

Know the business you invest in and keep it until you KNOW the story is changing.

Good luck everyone.
