Does anyone know how much AT&T had to pay up in private lawsuits?
I don't care if MSFT settles this case with the government as long as the private lawsuits don't pose too big of a threat (ie greater than 5 billion or so)to the company down the road.
I believe MSFT probably believes that the remedy determined by the judge will not be as bad as a negotiated settlement with the company. Furthermore, the appeals courts are friendly to the MSFT case and will only strengthen their resolve to overturn the Jackson ruling---using arguments that he got his facts wrong (especially the part about PCs on Intel based chips only--ie Wintel as being the market).
Furthermore, he had ignored the appeals courts ruling. I can see them getting back at him!

It may turn out not be all about law after all.
At this point i can see a lot of sympathy developing for MSFT. Big government may now be viewed as ruthless in their acts against this company.

In addition, MSFT has tested the waters with jury trials with great success. I can see them weighing that factor in assessing the potential claims against the company. I don't believe a jury would have sided with the DOJ in this case.
