You are opening up a whole philosophical argument here.
I think it's basically now a system for Lawyers, run by Lawyers and changing it back is unlikely because you have to get Lawyers to change it. For some reason most Americans believe that somewhere down the line they will need a Lawyer and benefit from it. The trial Lawyers have perpetuated this myth.
When I travel elsewhere in the world, people can't understand how Americans could be so gullable about Lawyers.
