Mike: No doubt there will be endless legal wrangling. And while that wrangling is going on, smart MSFT employees will be heading for the exits. Can MSFT "win" on appeal -- probably not, but anything is possible. MSFT cannot "win" in the large sense.. this whole fiasco shows that their notion of "winning" does not work. They could have and should have smelled the coffee a year ago, but choose to bull right along. Let them say they have a "strong" case all they like.. they saw a bug on their foot and so they shot at it, missed and shot themselves in the foot. Now the bug is making its way up their leg and they keep firing away, hitting themselves again and again. The bug is headed for their face and they are reloading -- I don't call that smart.

I wanted my car dealers to "unbundle" their pre-installed audio systems and put in one of my choice - being a connoisseur of sorts - but none of them would go for it.

Wonder why the DOJ hasn't thought of protecting us consumers in this respect.

The appellate courts do not look kindly on being told their business by district judges. The judicial pecking order is quite clear. Look for this to be one of the first conclusions struck down on the appeal.

1) You are using MSFT software when you logon to SI to write this memo, right?
2) You are a consumer, right?

3) Your stock is falling, right?
