Microsoft Scores Minor Win In Sun Java Suit (04/07/00, 6:47 p.m. ET) By Elizabeth Montalbano, Computer Reseller News A ruling issued late Wednesday gives Microsoft a minor victory in its ongoing legal battle with Sun Microsystems over Java licensing. Judge Ronald Whyte of the U.S. District Court in San Jose, Calif., denied a Sun (stock: SUNW) motion for summary judgment that would have supported the Palo Alto, Calif.-based company's claim that it does not have to supply Microsoft (stock: MSFT) with Java upgrades compatible with the software giant's currently available software. "It's a step in the right direction to [proving] Sun violated its contract with us and is trying to harm Microsoft's ability to compete," said a Microsoft spokesman. A Sun representative could not be immediately reached for comment. Wednesday's ruling follows a major decision by U.S. District Court Judge Thomas Penfield Jackson in the Department of Justice case against Microsoft that found the company guilty of violating the Sherman Antitrust Act. In his decision, Jackson cited the Sun Java case as an example of Microsoft violating the act. Following that ruling, Sun said it may consider filing a private lawsuit against Microsoft in light of the Justice Department antitrust ruling. =========================================================== Quicksand - Viewing this thing from the outside, it appears to me that our management is seeing this as a personal thing and is getting lost in our long term objective. I am beginning to feel that SUNW is spending too much time pursuing the courts rather than developing new and innovative solutions. Let's spend our money for our lawyers on developing patents and royalty agreements for our new emerging technology in JINI and other second generation software rather than a pissing match with MS! MS has it's own trouble with the Feds. SUNW has the advantage now, we do not need to rub MS's nose in this mess but rather leap ahead and focus on the next generation software and all these JINI devises. EKS
